Richards, intoxicated and belligerent, was refusing to leave Underwood\u2019s house at 514 East 8th Street. The two men were in the front yard when officers approached the scene on foot, and Richards held what appeared to be a rifle; it turned out to be a BB gun.\u00a0<\/span><\/p>\n<p><span style=\"\">Without either officer announcing their presence, Hutchins fired five shots at Richards with his secondary patrol weapon, an AR-15 style semiautomatic rifle, striking him twice. Hutchins later said he used deadly force because he feared for Underwood\u2019s life, although witnesses \u2014 and Underwood himself \u2014 said Underwood had already gone inside his home when Hutchins opened fire. Hutchins is white; Richards was Black.<\/span><\/p>\n<figure id=\"attachment_22899\" aria-describedby=\"caption-attachment-22899\" style=\"width: 300px\" class=\"wp-caption alignright\"><a href=\"http:\/\/arknews.org\/wp-content\/uploads\/2021\/08\/roy-richards-2-websize.jpeg\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-22899 size-full\" src=\"http:\/\/arknews.org\/wp-content\/uploads\/2021\/08\/roy-richards-2-websize.jpeg\" alt=\"\" width=\"300\" height=\"400\" \/><\/a><figcaption id=\"caption-attachment-22899\" class=\"wp-caption-text\"><em>Roy Richards (Courtesy Vanessa Cole)<\/em><\/figcaption><\/figure>\n<p><span style=\"\">An internal LRPD investigation cleared Hutchins of wrongdoing, and prosecutors did not charge him with a crime. But Vanessa Cole, Richards\u2019 sister, sued the officer on behalf of her brother\u2019s estate. Cole and her attorneys maintain that Hutchins should have had time to warn Richards before shooting. <\/span><\/p>\n<p><span style=\"\"><a href=\"https:\/\/arknews.org\/index.php\/2021\/08\/08\/little-rock-officer-headed-to-civil-trial-in-fatal-2016-shooting-of-roy-richards\/\">The Arkansas Nonprofit News Network reported in depth on the case earlier this month<\/a>, before the trial began.<\/span><\/p>\n<p><span style=\"\">The jury on Monday delivered its verdict to Chief U.S. District Judge D. Price Marshall Jr. after deliberating about three hours. The one-week trial had included testimony from Hutchins, Underwood, neighbors who observed the incident, expert witnesses and others.<\/span><\/p>\n<p><span style=\"\">Little Rock City Attorney Tom Carpenter, who represented Hutchins, said Wednesday the jury made the right call. Hutchins, he said, \u201cdid what he thought was the best thing to do\u201d that night in 2016.<\/span><\/p>\n<p><span style=\"\">\u201cI think the officer genuinely believed that Mr. Richards was a threat at that moment that the officer fired,\u201d Carpenter said. \u201cIt was only after the fact that it was discovered that [Richards\u2019 gun] was an air rifle and not another type of rifle. And that's the problem that officers have \u2014 they come into a situation where they don\u2019t know the individuals, and they have to make these almost instantaneous decisions.\u201d<\/span><\/p>\n<p><span style=\"\">Mike Laux, the lead attorney representing Cole, said he plans to appeal. The one-week trial included a number of \u201cirregularities,\u201d he said, including problems with how crucial questions of fact were asked of the jury and inconsistencies in how the jury answered.<\/span><\/p>\n<p><span style=\"\">The jury in the Hutchins case was asked to deliver two verdicts. Before deciding in favor of one party or the other, it first was told to resolve a series of factual questions about how events unfolded in the seconds leading up to Richards\u2019 death, including: Where was Richards pointing the BB gun when Hutchins fired? Was Richards facing the house or away from the house? Was Underwood inside or outside?<\/span><\/p>\n<p><span style=\"\">Answering those questions was a prerequisite to determining whether Hutchins actions were reasonable, according to a ruling by a federal judge in 2019 who rejected Hutchins\u2019 attempts to get the case thrown out of court on the basis of qualified immunity. A three-judge panel of the Eighth Circuit Court of Appeals agreed with that ruling in 2020, paving the way for a jury trial to proceed.<\/span><\/p>\n<figure id=\"attachment_22898\" aria-describedby=\"caption-attachment-22898\" style=\"width: 300px\" class=\"wp-caption alignright\"><a href=\"http:\/\/arknews.org\/wp-content\/uploads\/2021\/08\/Dennis-Hutchins-small.jpeg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-22898\" src=\"http:\/\/arknews.org\/wp-content\/uploads\/2021\/08\/Dennis-Hutchins-small.jpeg\" alt=\"\" width=\"300\" height=\"398\" \/><\/a><figcaption id=\"caption-attachment-22898\" class=\"wp-caption-text\"><em>Officer Dennis Hutchins (Source: Little Rock Police Department)<\/em><\/figcaption><\/figure>\n<p><span style=\"\"><a href=\"http:\/\/arknews.org\/wp-content\/uploads\/2021\/08\/special-interrogatories-Cole.pdf\">The verdict on the factual questions<\/a> was handed down on Friday<a href=\"http:\/\/arknews.org\/wp-content\/uploads\/2021\/08\/special-interrogatories-Cole.pdf\">.<\/a> The jury said Underwood was inside his home by the time Hutchins shot at Richards and that \u201cless than 3 seconds\u201d passed between Underwood closing the front door of his house and Hutchins opening fire. Yet the jury also answered \u201cno\u201d to a question asking whether it was \u201cfeasible for Hutchins to give Richards a warning before firing his rifle.\u201d<\/span><\/p>\n<p><span style=\"\">Laux said the two responses were at odds with one another. \u201cThat makes absolutely no sense,\u201d Laux said. \u201cThat is what you call an irreconcilable inconsistency \u2014 one that mandates a mistrial.\u201d (Earlier in the trial, he said, Hutchins himself acknowledged a warning could be given in as little time as one second.)<\/span><\/p>\n<p><span style=\"\">Laux said the responses indicate the questions were not well drafted and confused jurors. He also said <\/span><span style=\"\">the trial proceeded unusually quickly and noted Judge Marshall was also presiding over another case at the same time, <\/span><a href=\"https:\/\/arknews.org\/index.php\/2021\/08\/12\/hung-jury-on-all-but-one-count-in-gilbert-baker-trial-former-state-senator-acquitted-of-conspiracy-charge\/\"><span style=\"\">the criminal trial of former lobbyist and political fundraiser Gilbert Baker.<\/span><\/a><\/p>\n<p><span style=\"\">\u201cI think the frenetic pace that we were working at only caused jury confusion. And all of these irregularities we think are mostly a byproduct of this inexplicable desire to fast track this case,\u201d he said.<\/span><\/p>\n<p><span style=\"\">Carpenter said he was confident Hutchins would prevail on appeal.<\/span><\/p>\n<p><span style=\"\">\u201cIf it is appealed, you\u2019ve got a jury verdict, and it\u2019s very hard to overturn a jury verdict.
